The following are calculated as winter holidays:
Holidays in pursuant to the provisions of the collective agreement:
- 31 December
Holidays in pursuant to the provisions of the Act on Rest Periods:
In general, when assessing a claim, it is important to distinguish whether the employee was employed during the winter holidays or not.
Employees who were employed during the winter holidays, and whose company is subject to the winter holiday provision, can claim their entitlement to holiday pay from their company.
Employees who were not employed during the winter holidays, and who fulfil the requirements to earn a compensation entitlement to winter holiday compensation, can claim their winter holiday compensation entitlement from BUAK.
Requirements for a claim from BUAK while also receiving holiday compensation:
- Earned 14 qualifying weeks in a calendar year
- End of the employment contract before or during the winter holidays
