Hours in which the temperature exceeds +32.5°C (in the shade) are regarded as bad weather hours.
In principle, although § 5 (2) BSchEG stipulates that a standby period of three hours must be observed on the site (in case weather conditions change), this provision does not apply in cases of extreme heat as the temperature is likely to increase or stay the same rather than decrease until around 9 p.m.
BSchEG stipulates that the decision on whether or not work will take place in bad weather is the responsibility of the employer.
